Balochistan High Court Dismisses Petition on Afghan Deportation Challenge

Quetta [ Pakistan ], April 6 (ANI): The Balochistan The High Court (BHC) has dismissed a petition that contested the deport ARY News reported on the situation concerning Afghan refugees.

A panel of two judges consisting of Acting Chief Justice Muhammad Ejaz Swati and Justice Muhammad Aamir Nawaz Rana presided over the hearing of the petition submitted by Advocate Nusrat Hassan Afghani, according to ARY News on Saturday.

The individuals who initiated the request asked for judicial help to stop officials from intimidating people with POR (Proof of Registration) cards, ensuring they do not have their dignity or personal space violated, as well as preventing forced relocation until after the date specified in the notice issued on July 22, 2024.

In the course of the hearing, Additional Attorney General Muhammad Fareed Dogar informed the court that officials were adhering to the directive issued on July 22, 2024, and pledged strict compliance with legal standards, guaranteeing no mistreatment of the petitioners, Ary News reported.

Significantly, the previous year, the federal cabinet granted a one-year extension for the validity of POR (Proof of Registration) cards for 1.45 million Afghan refugees, extending their validity until June 30, 2025.

In the meantime, Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur stated that Afghan refugees will not be compelled to depart or be pushed towards the border.

He was against the government’s approach to dealing with those who had taken up arms. “We must understand the reasons behind their decision to take up weapons; they are part of us and we should embrace them,” stated the Chief Minister of Khyber Pakhtunkhwa at the event. “Terrorism can be resolved,” asserted Gandapur.

Regarding the repatriation of Afghan refugees, the Khyber Pakhtunkhwa (KP) Chief Minister stated, “We cannot forcibly return them to the border.” He added, “We will not deport Afghans unless the Afghan government agrees to receive them,” according to Gandapur.

He stated that the KP government will not compel any Afghan refugees to return. "It is essential for us to progress towards negotiating with Afghanistan ", he said.

Pakistan has postponed its deadline to deport Hundreds of thousands of Afghans left due to the Eidul Fitr holidays, according to The Express Tribune, quoting an official from the government.
